O prazo para os contribuintes que desejam aderir ao Programa de Recuperação de Créditos Fiscais (Refis) do Governo de Mato Grosso do Sul e efetuar o pagamento parcelado segue até o dia 11 de março de 2019. O período foi determinado pelo Conselho Nacional de Política Fazendária (Confaz). A modalidade oferece ótimas condições para quem deseja colocar as contas em dia com o fisco estadual.
Podem aderir ao Refis os contribuintes que possuem débitos com fatos geradores ocorridos até 30 de junho de 2018, constituídos ou não, inscritos ou não em dívida ativa, inclusive os ajuizados. Os interessados devem procurar a Agência Fazendária mais próxima ou acessar a página da Sefaz na internet.
O benefício de redução de juros e multas tem percentual que varia de acordo com o número de parcelas. Além disso, o contribuinte terá o nome excluído do cadastro da Dívida Ativa. As regras do Refis estão na Lei nº 5.285, de 7 de dezembro de 2018, que dispõe sobre formas excepcionais de pagamento de débitos relacionados ao Imposto Sobre Operações Relativas à Circulação de Mercadorias e Sobre Prestações de Serviços de Transporte Interestadual e Intermunicipal e de Comunicação (ICMS).
Opções de pagamento
As opções de pagamento aplicam-se aos valores devidos de ICMS ou que tenham sido objeto de declaração prestada nos termos do Simples Nacional e cuja cobrança, por decorrência de convênio celebrado com a União, tenha sido transferida para o Estado; ou ainda relativos a penalidades pelo descumprimento de obrigações acessórias referentes ao ICMS.
Conforme a Sefaz, as formas de pagamento são:
I – em duas ou em até 30 parcelas mensais e sucessivas, com redução de:
a) 60% das multas punitivas e moratórias; e
b) 60% dos juros de mora;
II – em 31 ou em até 60 parcelas mensais e sucessivas, com redução de:
a) 60% das multas punitivas e moratórias; e
b) 50% dos juros de mora.
No caso dos créditos tributários cujos valores tenham sido objeto de declaração prestada nos termos do Simples Nacional, o Refis obedecerá a seguinte forma de pagamento:
I – em duas ou até em 30 parcelas mensais e sucessivas, com redução de 60% das multas punitivas e moratórias;
II – em 31 ou em até 60 parcelas mensais e sucessivas, com redução de 60% das multas punitivas e moratórias.
Já os créditos tributários relativos a penalidades pelo descumprimento de obrigações acessórias referentes ao ICMS, inscritos ou não em dívida ativa, cuja infração tenha ocorrido até 30 de junho de 2018, podem ser liquidados:
I – em duas ou em até 30 parcelas mensais e sucessivas, com redução de 60% da multa correspondente;
II – em 31 ou em até 60 parcelas mensais e sucessivas, com redução de 50% da multa correspondente.
